This article is a new version of the constitution for the Federal Kingdom of Gensokyo, covering all articles.
The Preamble
By the request of Queen Marisa and a union of other monarchs, the people of our nation shall order themselves to establish a free, open society. The goals are to provide common defense and welfare, as well as secure the rights to all citizens as mentioned in this Constitution for the Federal Kingdom of Gensokyo.
Article I
Section 1: The Parliament
All legislative powers shall be vested in the form of a Parliament for the Federal Kingdom of Gensokyo, which shall consist of a Senate and House of Representatives.
Section 2: The House of Representatives
The House of Representatives shall be comprised of members elected every year ending in an even number by the people of the provinces for a term of two years. The number of Representatives in each province shall be enumerated for every 500,000 people within that province’s population.
A person can be elected as Representative if they have attained an age of 25 years, been a citizen of the Federal Kingdom of Gensokyo for seven years, and be an inhabitant of the province of their choice.
When vacancies happen for any province, the Monarch shall hold an election to fill such vacancies. The Lieutenant Prime Minister shall be the Speaker for the House of Representatives and shall have the sole power of impeachment. The Speaker shall have no vote unless they will be equally divided, and shall choose a pro tempore in the absence of the Lieutenant Prime Minister when they shall exercise the power of the Prime Minister of the Federal Kingdom of Gensokyo.
Section 3: The Senate
The Senate shall be comprised of two Senators from each province, chosen by the people for a term of six years. The seats of the Senate shall be divided into three classes, with the first class vacating at the expiration of the second year, the second class at the expiration of the fourth year, and the third class at the expiration of the sixth year. If vacancies occur by resignation, death, or impeachment, the Monarch shall hold a special election to fill such vacancies.
A person can be elected as Senator if they have attained an age of 30 years, been a citizen of the Federal Kingdom of Gensokyo for nine years, and be an inhabitant of the province of their choice.
The Prime Minister shall be the President of the Senate and shall have no vote unless they will be equally divided.
The Senate shall have the power to try all impeachments. During an impeachment, they shall be bound by oath or affirmation. When either the Monarch or Prime Minister is tried, the Chief Justice shall preside. No person may be convicted without a concurrence of two-thirds of the members present.
Section 4: Meeting of the Parliament
The Parliament shall assemble at least once a year, and such meeting shall be on the first Monday in February, unless they shall by law appoint a different day.
Section 5: Participation and Logs of Parliament Members
Both branches shall be the judge for federal elections, returns and qualifications of their own members, and a majority of each be authorized to compel the attendance of absent members and under such penalties as each branch may provide.
Both branches shall determine the rules of their proceedings, punish members for disorderly behavior, and expel a member under the concurrence of a two-thirds majority vote.
Both branches shall keep a journal of their proceedings and from time to time publish the same except for parts which may in their judgment require secrecy, and the Yeas and Nays for each legislative action shall be recorded.
Neither house may adjourn for a period of three days or more.
Section 6: Compensation of Parliament Members
All members of Parliament shall receive compensation for their services to be ascertained by law, and paid by the Royal Treasury of the Federal Kingdom of Gensokyo. They shall be in all cases be privileged from arrest during legislative sessions. No member of Parliament shall be appointed to any civil office under authority, and no person not holding any office shall be a member.
Section 7: Passing of Legislative Actions
All bills for legislative actions shall originate in the House of Representatives, but the Senate may propose or concur with amendments to this constitution as with other bills.
Every bill passed by both houses of parliament shall be presented to the Prime Minister and the Monarch. If they approve they shall sign it, but if not they may return it with their objections to the house it originates from where such objections be recorded in their journal and proceed to reconsider it.
If after such reconsideration from a two-thirds majority vote from that branch shall agree to pass that bill, it shall be sent to the other branch where they shall reconsider. If that house pends a two-third majority vote it shall become law. The names of the persons voting for or against shall be recorded in the journal of each branch.
Section 8: Taxation
The Parliament shall have the power to lay and collect taxes from all citizens of the Federal Kingdom of Gensokyo to pay the debt and provide for the defense and welfare of the Kingdom. These shall be uniform throughout the Kingdom to borrow money on the credit, regulate commerce with its foreign allies and other nations, establish uniform rules for naturalization, laws for bankruptcies, generate money and regulate its value, punish those for counterfeiting, establish post offices and roadways, promote the progress of science and arts by giving authors and inventors the exclusive rights to their writings and discoveries, define and punish the crimes of pirates and felons committed, declare war, raise and support the Gensokyo Royal Defense Force including their land, air, and naval operations, and make all other powers vested in this constitution executable.
Article II
Section 1: Executive Powers
The executive power shall be vested in the power of a Monarch headed by the Kirisame Dynasty. The Monarch may only perform actions allowed by this constitution, and members of the Kirisame Dynasty are forbidden from aligning themselves with any political party nor shall they be eligible for any Parliament office. All individuals who are declared descendants of Queen Marisa by blood are automatically declared members of the Kirisame Dynasty, regardless of their birthplace.
Part of the executive power shall also be vested by the Prime Minister, who shall hold the office for a term of four years, together with the Lieutenant Prime Minister. No person may be elected to the office of Prime Minister for more than two terms.
No person except a natural born citizen may be eligible for the office of Prime Minister, and neither shall any person who has not attained an age of 35 years and been 14 years a citizen of the Federal Kingdom of Gensokyo.
If in the case of the removal of the Monarch upon death, resignation, impeachment, or inability to discharge their powers and duties, the Monarch shall be succeeded by an Heir Apparent to the Monarch, whether it be a child, sibling, or other blood relative of the Kirisame Dynasty.
If in the case of the removal of the Prime Minister upon death, resignation, impeachment, or inability to discharge their powers and duties, the same shall apply for the Lieutenant Prime Minister. The Lieutenant Prime Minister shall vest the power of the Prime Minister, and the House of Representatives shall elect a Lieutenant Prime Minister.
The Monarch and Prime Minister shall at all times for their services receive compensation which shall never be diminished during the period the Monarch starts their reign or the Prime Minister assumes office.
Before the Monarch assumes the duties for which they execute, they shall take the following oath or affirmation – “I do solemnly swear that I will faithfully assume the throne as the Monarch of the Federal Kingdom of Gensokyo, and will to the best of my ability, preserve, protect, and defend the Constitution of the Federal Kingdom of Gensokyo.”
Before the Prime Minister assumes the duties for which they execute, they shall take the following oath or affirmation – “I do solemnly swear that I will faithfully execute the office of Prime Minister of the Federal Kingdom of Gensokyo, and will to the best of my ability, preserve, protect, and defend the Constitution of the Federal Kingdom of Gensokyo.”
Section 2: Command of the Gensokyo Royal Defense Force
The Monarch shall be the Commander in Chief of the Gensokyo Royal Defense Force. When militia is called into service, they may require the opinion in writing of the principal officer in each of the executive departments. They shall have the power to grant reprieves and pardons for offenses except in cases of impeachment.
They shall have the power and with advice from the Senate to make treaties, appoint ambassadors, other public ministers and consuls, judges of the Supreme Court, and all other officers of the Kingdom. The Monarch shall also have the power to fill up all vacancies that may happen during recess of the Senate.
Section 3: Address by the Monarch
The Monarch shall from time to time give to the Parliament information on the status of the Kingdom, recommending consideration on such measures they shall judge as necessary and expedient. They may on occasion convene both branches or either of them.
Section 4: Impeachment
The Monarch, Prime Minister, and all other officers of the Kingdom shall be removed from office on impeachment as a result of conviction on treason, bribery, or other crimes and misdemeanors.
Article III
Section 1: The Supreme Court
The judicial power of the Federal Kingdom of Gensokyo shall be vested in a Supreme Court and other inferior courts that the Kingdom may establish. The judges for each of the courts shall hold their offices under proper behavior and receive compensation that is not diminishable for their period in office.
Section 2: Judicial Power
Judicial power shall apply to all cases arising under this Constitution, the laws, and treaties. In cases involving ambassadors, public ministers and consuls, the Supreme Court shall appellate jurisdiction.
Section 3: Treason
Treason may only consist in levying war against them or in adhering to their enemies by giving them aid and comfort. A person may only be convicted of treason under testimony of at least two or more witnesses or confession in open court.
Article IV
Section 1: Full Faith and Credit
Full faith and credit shall be given in public acts, records, and judicial proceedings. Parliament may prescribe the manner in such acts, recordings, and proceedings are proved and their effects thereof.
Section 2: Citizens’ Rights
The citizens of all provinces shall be entitled to privileges and immunities granted by this constitution. Any person charged with a crime shall demand on the executive authority of the province.
Section 3: Admission of Provinces
New provinces may be admitted by Parliament into the Federal Kingdom of Gensokyo. No province may be formed or erected within the jurisdiction of any other province, the junction of two provinces, or parts of provinces without the consent and legislature of the provinces concerned as well as Parliament.
Section 4: Provincial Governments
The Kingdom shall guarantee that every province forms a Monarch along with a daimyo.
Article V
Parliament may propose amendments to this constitution upon a two-thirds majority vote.
Article VI
All debts contracted shall be valid against the Kingdom under this constitution. The constitution as well as all treaties made shall be the supreme law of the Federal Kingdom of Gensokyo. All Parliament members, as well as provincial legislatures shall be bound by oath or affirmation to support this Constitution.
