Why Website Agreements and Fine Print are Confusing to Consumers

Let’s face it: the average internet user has spent roughly over $600 in website microtransactions. Many are being charged without their consent or get banned from a site because they don’t understand the Terms of Service agreement or their Privacy Policy.

One user can have several accounts on several different websites. Many people don’t read the Terms of Service or Privacy Policy, usually skimming through it and clicking Agree. Many people find these contracts too confusing, as it features a lot of fine print, and will often have to consult a lawyer to help them understand it.

According to one study, three in four internet users don’t regularly read the agreements. Even though the age requirement for most websites is 13 (roughly 7th or 8th grade), these agreements usually require an 11th grade reading level. Half of all internet users read at a 9th grade level or below. On average, the agreement is roughly 5,000 words long. The less a user appears to understand, the better chance you’ll have getting banned for certain forms of wrongdoing or facing unexpected charges. Users can end up getting targeted by their education level.

Some websites with flashier offers fail to highlight hidden and backloaded fees or privacy rules. The last paragraph of an agreement usually includes the consequences for violating it and dispute resolution (which usually requires arbitration).
