Best Practices For Fan Content

If you decide to use any intellectual property produced by Drillimation Systems or other development partners, your use is subject to the Game Content and Brand Usage Rules and the End User License Agreement. We have a significant and loyal fanbase and community, and we are committed to ensuring players are treated fairly and the free speech rights of content creators are not obstructed.

Drillimation may contact you if we receive one or more reports and/or complaints regarding your fanworks, and determine it is non-compliant with the Game Content and Brand Usage Rules or End User License Agreement. To reduce the risk of your fanworks being removed under the DMCA for non-compliance, we highly recommend you review the practices below.

The Short

  • All fanworks must be age-appropriate for most players and not harm the brand.
  • All fanworks must not promote products that could be inappropriate or harmful to a child’s development or person’s health or safety.
  • All fanworks must be compliant with all local, national, and international laws and regulations.
  • You may not post instructions on how to gain access to the proprietary games for free or distribute illicit or counterfeit versions of the proprietary games.
  • While material from most released Drillimation games can be used in your content, material from unreleased games (not counting demo content) is harmful to the brand.
  • Your content may not be used for monetary gain. The only exceptions to this rule are for YouTube channels and Twitch streamers. This means you can’t create a fangame and sell it on a digital storefront for profit.
  • We do not allow any person to use footage or photographs of the Prophet Driller and/or other staff members without their permission. The only exceptions are versions of staff depicted as characters in games.

The Long

Violence and Gore

  • Most firearms and other weapons, and forms of combat in your content are acceptable.
  • Any content that is very brutal, grisly, depicts graphic torture, or sexual assault is not acceptable.
  • Please minimize the level of gore in your content (blood particles on hits). The Motion Picture Association of America and Entertainment Software Rating Board do not specifically call out firearms and other weapons, and hand-to-hand combat as a category, but they do fall under the violence category in rating descriptors and summaries.
  • Please be selective and cautious on terminology, as combat-related terms like “shoot”, “kill”, “bomb”, “punch”, and “kick”, as well as violent slang, can be harsh and triggering.
  • Weapons are a part of the Drillimation Danmaku Universe gameplay. Please exercise caution and sensitivity when creating or using this kind of content.

Sexuality and Nudity

  • Most swimwear in your content is acceptable.
  • Graphic or explicit nudity or sexuality (even if the characters involved are minors) is not acceptable.
  • Please minimize the level of fan service in your content (low-cut or revealing outfits, large chests or buttocks, or panty or cleavage shots). The Motion Picture Association of America and Entertainment Software Rating Board do not specifically call out suggestive body parts as categories, but they do fall under the suggestiveness and sexuality categories in rating descriptors and summaries.
  • Please be selective and cautious on terminology, as innuendo and sexual slang can be harsh and triggering.
  • While fan service is not part of the Drillimation Danmaku Universe gameplay and only for aesthetic purposes, please exercise caution and sensitivity when creating or using this kind of content.

Profanity and Language

  • Language that goes beyond polite conversation but are common and everyday expressions without any stronger words is acceptable.
  • Language that is on the mild and moderate sides of the spectrum are mostly acceptable, but any use of sexually harsher-derived or explicit language, or even discriminatory slurs is not acceptable.
  • Please minimize the use of violent or sexual slang in your content. The Motion Picture Association of America and Entertainment Software Rating Board do not specifically call out violent or sexual slang as categories, or even innuendo, but they do fall under the violence and sexuality categories in rating descriptors and summaries.
  • Please be selective and cautious on terminology, as most profane terms can be harsh and triggering.
  • Profanity is not part of the Drillimation Danmaku Universe gameplay, even at the mildest on the spectrum. Please exercise caution and sensitivity when creating or using this kind of content.

Drug and Alcohol Use

  • Most alcohol and tobacco use is acceptable, as long as the characters are appropriately aged and above the age of majority. Prescription medication use is also acceptable.
  • Content that promotes illegal or illicit substance use is not acceptable.
  • If you have underage characters attending a party, please minimize the level of alcohol in your content. The Motion Picture Association of America and Entertainment Software Rating Board classify alcohol, tobacco, and other drug content as separate descriptors, but they do fall under the substance use category in descriptors and summaries.
  • Please be selective and cautious on terminology, as substance related terms such as “drunk” and “overdose” can be harsh and triggering.
  • Substance use is not part of the Drillimation Danmaku Universe gameplay, with the only exceptions being prescription medication and vitamins. Please exercise caution and sensitivity when creating or using this kind of content.

Gambling

  • Depictions of luck-based and casino table games where wagers are not made are acceptable.
  • Many jurisdictions around the world do not permit gambling. Content that encourages or teaches gambling, or accepts wagers, no matter if the currency is real or virtual, is not acceptable.
  • If you have underage characters participating in a luck-based game, please refrain from allowing players to bet or wager, or mentioning currency if your content is non-interactive. The Motion Picture Association of America does not have a specific category related to gambling since films and TV shows are non-interactive media. The Entertainment Software Rating Board does have a specific category related to gambling, since video games are interactive media.
  • Please be selective and cautious on terminology, as gambling related terms such as “casino”, “wager”, and “bet” can be harsh and triggering.
  • Gambling is not part of the Drillimation Danmaku Universe gameplay. Please exercise caution and sensitivity when creating or using this kind of content.

Politically Sensitive Content

  • Characters such as presidents, prime ministers, royalty, and other office positions are mostly acceptable as long as they are not affiliated with any political ideology or party.
  • Many jurisdictions around the world do not permit political speech in some form. This is because any discussions around it can ignite a flame war, and unnecessary flame wars are not good for the people.
  • The Motion Picture Association of America and Entertainment Software Rating Board do not have a specific category related to politics, but it does fall under the thematic elements category in descriptors and summaries.
  • Please be selective and cautious on terminology, as politics related terms such as “liberal”, “conservative”, “democrat”, “republican”, “socialist”, or “communist” can be harsh and triggering.
  • Since Touhou Kourinden ~ Mythos of Phantasmagoria, characters holding royalty and other office positions have moved to a nonpartisan stance and politics is no longer part of the Drillimation Danmaku Universe gameplay. Please exercise caution and sensitivity when creating or using this kind of content.

Restricted Content

  • Restricted content includes voices or images of individuals who have not signed contracts for use of their face and/or voice in fan content, or content from games that have not yet been released, with the exception of demo content.
  • The Game Content and Brand Usage Rules does not cover the use of staff footage or other photographs and such uses may infringe on a person’s right of privacy and publicity. In order to legally use restricted content, you must license the use separately from Drillimation Systems or any of its dealers or distributors.
  • Some of the individuals featured in photos or videos on our YouTube channel or other social media platforms are not public figures. This means they are entitled to control the use of their voice and/or image. This is an example of restricted content and use of footage or photos requires special licensing from those person(s) and/or their estates, and may be subject to applicable fees.
  • Use of unreleased content is a huge violation of both the Game Content and Brand Usage Rules and End User License Agreement. Please wait until the actual title is released before you can start using such content.
  • Please be aware of using material that is not copyright-cleared for use in your content, and these uses are not covered under the Game Content and Brand Usage Rules. Such examples include the various Touhou Project characters, elements, and music that appear in games. Sometimes, it may be removed or replaced in some games to respect the copyright owner of the franchise.

General Content

  • Creators should be clear about the existence of these thematic elements to ensure consumers are aware.
  • Creators should consider how access to their content is handled by both minors and adults.
